A New Brunswick man is free after his re-trial has come to a conclusion. Dennis Oland was accused and found guilty by jury of second degree murder after the death of his father in 2011. He was sentenced to life in prison in 2015. He spent just under a year in jail before the New Brunswick Court of Appeal overturned the ruling, stating an error on the judge's part and a new trial was ordered. The 44 day re-trial was done in front of a judge only.

Justice Terrace Morrison delivered his non guilty verdict this morning to a packed court room in Saint John, N.B. Justice Morrison decided that the Crown did not provide sufficient evidence to prove "beyond a reasonable doubt" that Oland killed his father.

Oland's father was found dead by his assistant in one of his offices. The evidence given at the trials says that Oland was the last know person to see his father before he was found beaten to death. The weapon was never found.

Oland and his family had big smiles as they left the court house today. Oland's extend family including his mother have supported his innocence for years.

The prosecution has not commented on whether they will appeal the "not guilty" verdict, they have 30 days to decide.
